Terms

These Terms of Use ("Terms") govern your use of the PickMe mobile app and related services (the "Service"), provided by Kaan Sönmez, operating under the Vandly brand ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use PickMe. By using the Service, you confirm that you meet this requirement and that you can form a binding agreement with us.

2. Your account

You are responsible for your account and for keeping your sign-in details secure. Provide accurate information, keep one account per person, and do not share or sell your account. Tell us at support@vandly.ai if you believe your account has been compromised.

3. Zero tolerance for objectionable content and abusive users

PickMe has zero tolerance for objectionable content and abusive behaviour. You must not post, send or share content that:

• is illegal, or promotes illegal activity;
• harasses, bullies, threatens or intimidates anyone;
• is hateful or discriminatory based on race, ethnicity, national origin, religion, gender, sexual orientation, disability or similar characteristics;
• is sexually explicit, or sexualises minors in any way;
• depicts or promotes violence, self-harm or suicide;
• contains another person's private information without their consent (such as addresses, phone numbers or ID documents);
• impersonates another person or organisation, or is misleading or fraudulent;
• is spam, scams, or unsolicited advertising;
• infringes someone else's intellectual property or other rights.

You must also not:

• manipulate votes or results, including through multiple accounts, bots or automated tools;
• interfere with, scrape, reverse-engineer or attempt to gain unauthorised access to the Service;
• use the Service to send malware or to harm other users.

4. Reporting, blocking and moderation

You can report any question, comment or user, and block any user, from within the app. Blocked users' content is hidden from you.

We review reports and act on objectionable content within 24 hours of it being reported, including by removing the content and, where appropriate, suspending or permanently removing the account of the user who posted it. We may also remove content or restrict accounts on our own initiative if we believe they breach these Terms or the law.

5. Your content

You keep ownership of the content you post ("Your Content"). By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute Your Content solely to operate, provide and promote the Service. This licence ends when you delete Your Content or your account, except for copies other users have already saved or shared, or copies we must keep by law.

You are responsible for Your Content and confirm that you have the rights needed to post it. Votes and results reflect the opinions of other users; they are not advice.

6. Direct messages

Direct messages are deleted automatically 48 hours after they are sent, unless a participant saves them. The same rules in Section 3 apply to messages. Messages can be reported like any other content.

7. Links, product recommendations and affiliate links

Questions may contain links to third-party websites or products. We do not control and are not responsible for third-party sites. Some product links in the Service may be affiliate links, which means we may earn a commission if you make a purchase. This does not change the price you pay.

8. Intellectual property

The Service, including its design, software, logos and the PickMe and Vandly names, is owned by us or our licensors and is protected by law. We grant you a personal, non-transferable, revocable licence to use the app for your own non-commercial use in accordance with these Terms.

9. App store terms

If you downloaded PickMe from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (Standard EULA). These Terms are between you and us, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Similar terms apply if you downloaded the app from Google Play.

10. Suspension and termination

You can stop using the Service and delete your account at any time from Settings in the app. We may suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, or to protect other users or the Service.

11. Changes to the Service and these Terms

We may change, suspend or discontinue parts of the Service at any time. We may update these Terms; if the changes are material, we will notify you in the app or by email before they take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties that the Service will be uninterrupted, error-free or secure, or that content posted by users is accurate or reliable. Decisions you make based on votes or content in the Service are your own responsibility.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or intent, or your mandatory rights as a consumer.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara have jurisdiction, without prejudice to any mandatory consumer protection rights you have under the laws of the country where you live.
